5 tips before hiring the lawyer you need

Tip 1. Define your legal needs: be clear about the kind of legal problem you have and the kind of lawyer you need. Look into the practice areas of law, such as CIVIL, CRIMINAL, EMPLOYMENT, FAMILY or TAX, among others. That way you can identify the speciality that best fits your case. It is not ideal to hire, say, a criminal lawyer to claim payment of a debt, just as it is not right to hire a civil lawyer to get you out of jail. Picture a gynaecologist performing open-heart surgery. ¡ALL WRONG!

Tip 2. Look for recommendations: Ask friends, relatives or colleagues who have had good experiences with lawyers. If you cannot find any, search online and pay particular attention to comments from genuine clients about the lawyer's work. I recommend not believing everything you see on the web, good or bad: the most "TikTok-famous" lawyer, or the one with the best digital marketing, is not always the right one for your case. 

Tip 3. Check experience and credentials: Research the lawyer's academic background, their experience in cases similar to yours, and whether they hold any certification or distinction that sets them apart. You can check the SENESCYT website to verify that the speciality the lawyer advertises has academic backing, and you can even search the judiciary's system to see whether the lawyer has proceedings against them. Be careful: while looking for a criminal-law specialist, you may end up hiring an actual CRIMINAL.

Tip 4. Arrange a first meeting: Before hiring a lawyer, ask for an appointment to speak with them directly, preferably in person, to confirm that they work from a real office and are not a "nomad" lawyer. That way you will know where to find them if you cannot reach them by other means. At the meeting, explain your case and notice how they treat you: whether they listen carefully, explain things clearly and inspire confidence. Bear in mind that a lawyer is entitled to charge for the consultation, just as a private doctor does when you book an appointment. 

Tip 5. Agree the fees: Clarify the cost of the legal services from the outset. Some lawyers charge a fixed amount in advance, others an amount payable in instalments, others a percentage of the outcome of the case, and some offer packages with fixed prices for specific services. There are even professionals who charge by the hour, which is not very common in Ecuador. Make sure you understand what the price includes and that you sign a professional fee agreement. There should be no embarrassment in talking about money with your lawyer, negotiating the costs fairly and putting the agreements in writing. THIS WILL SAVE YOU A GREAT DEAL OF TROUBLE.

Bonus:

· Trust your instinct: If you do not feel comfortable with a lawyer, look for another one. The lawyer-client relationship rests on trust and open communication. A lawyer who never answers you, or who makes you feel they are doing you a favour rather than providing a service, is not right for your case.

· When a lawyer guarantees you results, that is a RED FLAG: we can guarantee our diligent work, but not the decisions that judges or other authorities may take. Watch out for that.

· Decide whether you want to hire a single lawyer or a law firm. Hiring a firm costs more, but the level of service is generally better than that of a lawyer working alone, with no office and no assistant, roaming the world as a lone wolf.
